CHATHAM — A Pittsylvania County woman requesting that the Circuit Court halt the Board of Supervisors’ plans to build an industrial megapark off Berry Hill Road filed a summary judgment Tuesday challenging the county’s bond agreement for the project.
Nancy Barbour Smith alleges that the Danville-Pittsylvania Regional Industrial Facility Authority’s bond agreement with the city and county, who would be joint developers of the $13 million park, is not legal under current state law.
Smith had originally petitioned Pittsylvania County Circuit Court to order the Board of Supervisors to hold a public hearing before it decided to allocate $4.19 million toward a bond issued by the Regional Industrial Facility Authority to help pay for the 3,500-acre megapark. Smith also is challenging the fact that the supervisors didn’t hold a public hearing on plans to give the money to RIFA.
RIFA has since filed a bond resolution on Dec. 2.
County Attorney John Light has asked a Circuit Court judge to dismiss Smith’s case.
The judge said Friday he would take the motion under advisement and rule on it later.
County officials have said they would like to attract an automobile manufacturer to the megapark. RIFA already has purchased part of the property.
