UPDATE: Thursday 4:46 p.m.:

A Circuit Court judge has removed the Pittsylvania County Commonwealth Attorney’s Office from the case involving a deputy that was wounded Tuesday night before shooting and killing an inmate in Chatham.

Judge Charles Strauss appointed Campbell County Commonwealth’s Attorney Neil Vener as special prosecutor to the case Wednesday. Strauss’s order came at the request of Pittsylvania County Commonwealth’s Attorney David Grimes.

The inmate has been identified as convicted sex offender Cody Christopher Nifong, but authorities have not released the deputy’s identity.

A Pittsylvania County Jail inmate killed in a struggle with a deputy Tuesday night was a Danville man who had recently been convicted of sexually assaulting a 13-year-old girl.

Cody Christopher Nifong, 24, was to have been sentenced Jan. 8 after undergoing a mental evaluation.

On Tuesday night, a Pittsylvania deputy was taking Nifong back to the jail after a medical appointment when the two began struggling in the deputy’s cruiser, authorities said.

The deputy, who has not been identified, was shot and wounded. Nifong was fatally shot, according to state police, who still are investigating the altercation.

The deputy was released from Danville Regional Medical Center after being treated for injuries that were not life-threatening.

Nifong, whose 25th birthday would have been Sunday, pleaded no contest in Pittsylvania Circuit Court on Nov. 25 to charges of object sexual penetration and taking indecent liberties. He was convicted on both counts.

The charges stem from May 27, when Nifong assaulted an acquaintance at a pond.

At the November court hearing, a judge ordered Nifong to undergo a mental evaluation before his Jan. 8 sentencing. It was unclear Wednesday whether that evaluation was the purpose of Nifong’s medical appointment Tuesday.

The Sheriff’s Office referred all questions to the state police. Officials there referred the questions to the Pittsylvania commonwealth’s attorney, who could not be reached.

Law enforcement officials refuse to release the name of the Pittsylvania County sheriff’s deputy who was shot and wounded Tuesday night in Chatham while transporting an inmate.

The deputy received minor injuries after he was shot at about 7 p.m. Tuesday near the intersection of North Main Street and Military Drive.

The inmate, who the Virginia State Police identified Wednesday as Cody Christopher Nifong, was shot and killed by the deputy, state police said.

The deputy was transporting Nifong back to the Pittsylvania County Jail after a medical appointment when a struggle ensued, State Police Sgt. Robert Carpentieri said in a news release. 

Taylor said he asked the Virginia State Police Bureau of Criminal Investigation to conduct an independent investigation. The sheriff would not provide further details and referred questions to the state police.

Carpentieri declined to reveal the deputy’s identity when contacted Wednesday and referred questions to the Pittsylvania County Commonwealth’s Attorney’s Office.

Lt. Timothy Lyon, with the state bureau of investigation, declined to release details about the incident.

According to section 2.2-3706 of the Freedom of Information Act, authorities are supposed to provide “Criminal incident information,” meaning “a general description of the criminal activity reported, the date and general location the alleged crime was committed, the identity of the investigating officer and a general description of any injuries suffered or property damaged or stolen.” 

FOIA requires that “law-enforcement agencies shall make available upon request criminal incident information relating to felony offenses.

However, where the release of criminal incident information is likely to jeopardize an ongoing investigation or prosecution or the safety of an individual; cause a suspect to flee or evade detection; or result in the destruction of evidence, such information may be withheld until the above-referenced damage is no longer likely to occur from release of the information.”

In response, Lyon said that when the state police are conducting an ongoing investigation, they do not release information. Instead, they will report their findings in this case to the Commonwealth’s Attorney’s Office and let them determine what to release, Lyon said. 

Attempts to reach Commonwealth’s Attorney David Grimes were unsuccessful Wednesday.

A message left at Danville Regional Medical Center to confirm whether the deputy is being treated there was not returned Wednesday.

Let me set the record straight before any one accuses me of being a police officer or a sheriff’s deputy. I am neither. I am just a citizen. Plain Jane. What is the big deal if they will not release the name of the officer? Who cares? This man is someone who was able to get away with just a shot in the wrist. It could have been a lot worse. Let the man be. He is suffering enough knowing he took a life. He probally didn’t mean to do that. He was probally just going to shoot the inmate to get him off of him. Now he has to spend the rest of his life knowing he took a life. Let the man be. None of us know what the officer is going thru and we must let him get on with his life.

He got what he deserved. I have no tolerance for child molesters. Takes a real man to mess with a child. They all should see the same fate.

Last night on Star News his step father was on there for 1 hour. It was sick to hear it. It was almost like the fellow was a saint. And it was all the Sheriff’s office fault his step son was dead. He did not even raise the boy.

Give the deputy some time to adjust to what has happened.
My god. Nobody needs to know his name yet.
He/she was doing their job.
This will affect them forever.

The inmate took a gamble and lost.

Now that we are in the next days.

We know that the state police is handling the case. But the article fails to mention that they have requested a special prosecutor from Campbell County to assist them.

This is another good move for the county.

All the agencies rsponsible in investigating the incident will turn over the evidence when completed and the commonwealth attorney in charge will release the information to the public,all the news agencies wanting the information will get the report,whether it is good enough for them will is left to be seen,theres no hidden agenda here,theres nothing being being done with this investigation thats different from any other incident investigation by the state police,thats why local agencies involved in incidents like these let the state investigate them to keep the investigation just and fair to everyone involved including the news media.Lets not hinder the investigation by pressing for the information before its ready.

Well now let’s see what we have here. Going by the FOIA requirements, we know that an inmate was killed in a struggle with a Deputy. The date and location has been given in the paper’s article as occuring in Chatham. Lt Lyons, with the State Police division of the BCI released this information to the press. And as far as we can tell, the inmate being transported by the Deputy engaged in a struggle with that Deputy. Since I don’t have a college degree, like all of these bright young reporters do, I can only deduce that the inmate was attempting to either escape, or kill the Deputy. It would appear that law enforcement has complied with the FOIA, as we have read a general description of the activity reported, the date and general location of this incident, the BCI is investigating under the command of Lt. Lyons, and the injury(ies) suffered were gunshots.

It must be nice to quote the section of code pertaining to the FOIA. Too bad this paper can’t stick to responsible reporting and allow the BCI to investigate and report. As usual, our Lynchburg paper would much rather try the case now on speculation and skip the technicalities of fact. Just another shining example of media induced drama to compete with the National Enquirer in their never ending goal of sensationalism reporting! Oh happy days!!!

The FOIA does not require police to give out information about a ongoing investigation.  It is silly for this paper to write about the FOIA in this context when you ignore it in almost every other situation!!
