Jarris Butler has been sentenced to 10 years and three months in prison for shooting three men during a March 31 fight in front of his home on Oxford Street.

“I didn’t mean to do it, I was scared,” Butler told Danville Circuit Court Judge Joseph Milam at the sentencing hearing. “What else was I supposed to do?”

Butler, 18, faced sentencing on two counts of the use of a firearm in the commission of a felony, two counts of malicious wounding, one count of assault and battery and one count of possession of a firearm by a juvenile.

Butler, who was 17 at the time of the incident, had argued with his pregnant girlfriend earlier in the day and pushed her, he said during the sentencing hearing Monday. She told her brother about the argument, and the brother took two friends with him to Butler’s home to confront him.

During that confrontation, Butler shot all three of the men with a pistol-grip, pump-action shotgun. One was injured in a leg, another in the hand and the third was shot in the face.

According to testimony at the sentencing hearing, the man shot in the face has lost his left eye, has some ongoing problems with his right eye and is still being treated for his injuries. His medical bills alone have exceeded $70,000.

Butler’s attorney, Claudette Robertson, said she and Butler both realized he would have to serve a minimum of eight years for the firearms charges, but asked for leniency on the other charges.

Robertson said that despite Butler’s juvenile record — which includes being suspended from school for having a gun and some other assault charges — he had been working on turning his life around.

“He was doing things right until this night,” she said, calling the evening of March 31 a “tragedy.”

Senior Assistant Commonwealth’s Attorney Michael Newman agreed that the shootings were a tragedy, but said Butler lied to the police, fled the scene and asked his brother to hide the gun.

He also noted that Butler and his friends had guns on hand that day “because they were worried about something that happened earlier in the day.”

Newman said the fight started out as a one-on-one fistfight between Butler and his girlfriend’s brother, but that Butler went for the gun when he was losing that battle.

He also noted that leniency beyond the eight-year mandatory sentence for the gun charges would include no punishment for the victims’ injuries.

“At some point, he (Butler) will get out,” Newman said. “But (one of the shooting victims) will never have his sight.”

Butler testified in his own behalf, saying he was sorry for the incident. His mother and pastor also testified on his behalf, saying he was turning his life around and wanted to be a good parent to his 2-month-old son by one girlfriend and a second child due in August by the woman he argued with on March 31.

Milam said the jury rejected Butler’s claims of self-defense during the June trial, and said it is unfortunate Butler would not give up guns, even after getting in trouble with them before.

“I think the jury got it right,” Milam said. “This case is an example of why we shouldn’t have guns. Once the trigger is pulled, the damage is done.”

In addition to the mandatory eight-year sentence on the two firearms charge, Milam sentenced Butler to seven years for each of the malicious wounding charges, suspending all but 2 years; 12 months suspended for the possession of a firearm charge; and 12 months, with nine suspended, on the assault and battery charge.

In addition, Butler will have two years of probation that will include parenting classes, anger management and substance abuse counseling, and will be on good behavior for 25 years. Milam also ordered Butler to make restitution for his victims’ medical bills.

Really sounds like he was turning his life around… at 17 years old, he has two babies by two different girls, carrying around a pistol grip shotgun, and pushing his pregnant girlfriend. I’d hate to see what he was doing before!

Well I think that goes to show the voters something….........If this defense attorney wins as Commonwealth Attorney…....this could be what we have to look forward to. I guess it will be lighter sentances for those that break the laws! I stand by and thank God for the Commonwealth Attorney’s that we have now and support them all the way! I know that if something happens to my family/friends I want someone that will ask for the max!! That is what we have now….....If we want to send a message to the people it has to start with the courts and the people that win cases…..I REST MY CASE!

Hey LiveLove, I agree with you as far as the role models they try to emulate.  I just wish kids didn’t have to go through this, on either side of the altercation.  But I still say it was a panty waisted judge,  it is ridiculous to get such a short sentence for something like that.

Of course all of a sudden he is changing his life and turning it around.  He is turning it around so he could and lets remember he did get less time.  He should have gotten life in prison.  What is wrong with our system today.  You can do anything and get by with it,it seems.  Danville is a poor place to live and the justice system made it that way.

Please folks; believe this!!!  On rare occasions does not ignorance breed ignorance!!!???  Intelligence is inherited through the maternal side, and when you have a loss of Nature vs. Nurture, and the no-father symptom; this leads to a syndrome…  So damned frustrating, layin’ up in the bed, doing drugs and alcohol, drawing welfare, spittin’ out children for society to finance and feel sorry for, only to collect at the taxpayers expence to rear (you raise livestock and rear children) these less-than 70 IQ idiots who will never conform to, or amount to, anything who will contribute to society other than 3 hots and cot…  I was borne too late and fought for so much and received so little…  What a waste when we need contributions to society so MUCH!!!

Well, if someone came to my home to fight ME…I’d probably start shooting too, I think. BUT I know it’s not all about the parents…BUT where was a mom or dad or some other grown up in this situation. And I hope the guys that came to fight this kid were not grown men. But anyway I do agree that non violent drug offenders get way more time then the people out here actually killing and seriously hurting people. This should be a lesson to alot of young people and some grown ups to stay out of the trouble and stop trying to be so tough…it doesn’t get them anywhere but PRISON. These kids try so hard to emulate what they see portrayed by rappers in songs and videos, but most of these rappers don’t even actually live the gun toting life style they irresponsibly display, they have bodyguards to do their dirty work. And for this little boy I hope he does not drop any soap…so sad.

Unless I missed something I think the reason he got off kind of light is because the people he shot came to his house to fight. I see both sides on this one. They went looking for a fight and got caught slipping. He was seventeen at the time of the accident so where did he get a gun from anyway. Looks to me like his parents need some of that time he got.

Sure, blame it on the guns.  Try to take them away from anyone, follow the liberal democratic way.

I wish the victims would have been armed.  Then we wouldn’t have to be looking at a story such as this with a panty-waisted judge.  I have seen people caught for some pot get more time.  And that is non-violent.  No one was helped by this weak penalty verdict but the perpetrator.  Pitiful.  Less than 5 years, he will do it again.  Maybe next time he will get what he deserves.  I hope so.
