Daniel gets three life terms plus 10 years, $100,000 fine

At a funeral home months ago, Courtney Marie Servais lay covered — except for one hand for family to hold — while loved ones viewed her body, which had been too brutalized for an open-casket funeral.

Dennis Lee Daniel, 43, was found guilty by jury Monday of first-degree murder, abduction, carjacking and robbery in the Dec. 19 killing of Servais. He received three life sentences plus 10 years and a $100,000 fine.

Before Daniel was sentenced, family testified to the impact of Servais’ death.

Steven Servais, Courtney’s husband, said he didn’t know what to tell his three children — ages 10, 8 and 3 — after they ask about their mother.

Lawrence Turpin, Courtney’s father, talked about the day Courtney was born, and his role during the early years of her life. By preschool, Turpin said he learned how to fashion his daughter’s hair into a couple of different hairstyles; though on the first try, he couldn’t get her pigtails even.

Turpin said Courtney was a daddy’s girl.

“Anyone here would think that the last year of my daughter’s life was how she lived her entire life,” Turpin said. “It was not.”

Pittsylvania County Commonwealth’s Attorney David Grimes showed the jury photographs of Servais’ life as her mother smiled at each photo from the witness stand.

“There are no words in the English language to describe how her death has altered my life,” said Debra Emerson, her mother.

Daniel spoke before the judge imposed the jury’s sentences. Daniel said he deserved the death penalty, and he acknowledged Servais’ family.

“I know this is a hell of a loss for them,” Daniel said. “There’s nothing I can say that will help them right now.”

He added that the trial has been hard on his family as well. Daniel maintained that he did not rob Servais on Dec. 19.

“Today I forgive myself,” Daniel said. “I won’t fight it, but I have to put it behind me. I love that girl, and she didn’t deserve it.”

Insufficient evidence

Judge Charles Strauss struck the capital murder charge Monday morning as court proceedings began. To be charged with capital murder, a defendant must commit a first-degree murder in the commission of another serious felony, in this case, robbery. Defense attorneys had moved twice to strike the capital murder charge because they said the prosecution had not established that the robbery of Servais was the motive for the killing.

Strauss said the evidence did not establish that Daniel took Servais’ money or jewelry. Daniel also did not kill Servais to take her car, Strauss added. He disagreed with Grimes’ argument that the car was the “fruit of the robbery,” and the killing was part of the same criminal enterprise.

“The evidence is simply insufficient,” Strauss said.

Grimes and defense attorney Steven Milani gave closing arguments after the judge struck the capital murder charge.

Servais was the victim of Daniel’s sense of justice, Grimes said.

“Her trial began Dec. 5, 2008,” Grimes said of the day that Daniel learned Servais slept with his son. “It’s the kind of trial the defendant would have. This is not a case about respect. Respect is something that a person earns.

“It’s a case about a bully, who seemed to believe he was entitled to respect.”

Grimes said that Daniel planned on killing Servais since that day in December.

Milani, one of Daniel’s defense attorneys, said that Servais’ killing was not premeditated. Milani said that testimony portrayed Daniel as an impulsive person who went back and forth between extreme emotions. He cited Daniel’s testimony during the trial, when he said that he didn’t mean to kill Servais.

Milani asked the jury not to find Daniel guilty of first-degree murder.

Oops, it seems like there are alot more incidents of people committing the “same type” of crimes, multiple times (and getting more violent each time) before the courts will do anything about it. Forget “3 strikes and you’re out”, it’s more like 3 strikes and we will have to take you seriously. Virginia makes more money on one person going in and out of jail/prison say 5 times for one year each time than that same person going just one time for 500 years. The judicial system is really messed up and allows alot of peoples lives to be destroyed in the process.
If anyone questions this just do the research….it’s all about money!

He doesn’t care about the fine.  He is serving life without, so what can they do if he doesn’t pay?

It will take a long time to pay back $100,000 at convict pay of about 28 cents per hour.

This same Daniel was tried in or about 1998 for an almost identical crimes except the woman did not die. The same Grimes and his assistant Hurt made a big show of the fact that the Jury gave Daniels a sentence of HUNDREDs of years (think over 500) to serve in prison. Afterwards, the case was sent back for a new trial-Grimes and Hurt never told us why- and he got maybe 2 or 3 years and was out by 2001. So why wasn’t this brought out in the newspaper? And/or the Trial? This lady would still be alive today had Justice been done in 1998.

I think he got exactly what he deserved. Courtney can never be brought back. and he’ll never see the light of day, outside of a prison, ever again which is exactly what he deserves. and one day, he’ll answer to a higher power. what he did was brutal and awful, but that doesn’t define who Courtney Servais was.. may her soul rest in peace.

Thanks Oreo!  I was beginning to think I had missed something.  Don’t get me wrong, I respect the opinions of others no matter what they are, but I find it a little disrespectful to add these types of comments on this type of article especially when I’m sure there are other articles about uranium mining on this site to which these comments could be added.  Please - Uranium people - go post your comments where they belong and not here!

oops, show me where someone is trying to break the Uranium Mining law ban?  I must have missed it.  And I read the news several times each day.  There are some who are trying legally to have the law changed, but that is perfectly legal and happens quite often.  A few years ago, they changed the law on speed limits to allow 65.  I guess everyone who does 65 since the law was changed is a criminal?  OOPS indeed!

Oops - this is just for you.

Go to “The Washington Post.com” and check out the article about Nuclear Power.  Seems cooler heads have finally prevailed and discovered what many of us have known all along.  That is if you really believe in this fairy tale called global warming, you should be out on every street corner shouting for the construction of new nuclear power plants.  Everybody, and I mean everybody, that’s ever taken an unbiased look at power plant emissions will tell you the cleanest energy is nuclear energy. 

That being said, the requirement for uranium will increase proportionally to the increase in the number of new nuclear power plants.  The question is, will Pittsylvania County and Virginia take advantage of this economic opportunity, or will they accept the nonsense and fearmongering about polluted water and national security and all that other crap?

And, oops, the great thing about this is you don’t have to take my word for it.  Just go read the article at washingtonpost.com.
