Pelham, N.C., man receives 17-year sentence in wife’s death
A Pelham, N.C., man will spend 17 years in prison after pleading guilty to the Jan. 14, 2008, murder of his wife.
Major Woody Myers, 42, called 911 after the incident, authorities reported at the time, but left the scene before police arrived.
Police arrived at the couple’s Arch Cook Road home to find Darlene Myers face down on the kitchen floor with a gunshot wound to the back of her head. She was still alive when emergency workers arrived and was airlifted to Duke University Medical Center, where she died about 90 minutes later.
Prior to the shooting, Major Myers was firing a gun into the woods from his backyard. The neighbor told police he warned Myers that someone could be shot. The neighbor told authorities Myers then threatened to shoot him.
Darlene Myers returned home, and an argument began between her and her husband, according to the initial incident report. A witness told police he saw Major Myers run out of the residence and leave shortly before police arrived.
Major Myers was located and charged with first-degree murder. He pleaded not guilty and faced a jury trial that began Feb. 16.
Joel Brewer, the district attorney for Caswell and Person counties, said Myers contended his wife’s death was an accident, the shooting was not planned and he and his wife had been arguing prior to the incident.
“We showed under cross-examination that his explanation was pretty ridiculous,“ Brewer said.
Once the cross-examination ended Feb. 18, Brewer said, Myers changed his plea to guilty of second-degree murder.
“The jury could have returned a sentence of first-degree or second-degree murder or involuntary manslaughter or not guilty,“ Brewer said. “He was afraid of a life sentence for first-degree (murder).“
North Carolina courts base sentence lengths on a number of factors, including the prior criminal record of the defendant. Brewer said Myers’ prior record was not extensive but did include a 1994 charge for assaulting his wife with a deadly weapon.
Brewer said the 17-year sentence was at the high end of sentencing guidelines for second-degree murder but felt it was a just punishment.
“He pled guilty to what he did,“ Brewer said.

r u kidding me, not enough suspension in school????? u mean not enough therapy !!!! second degree is a joke, should have been life, he knew what he was doing, no matter what situation led up to the killing she is still dead and her children have no mother, has this punishment been just???? I think not….......
You have misguided compassion my friend, and I can’t help but wonder why! My son was shot through his brain when he came from work and walked in on his home being burglarized. Half of his brain was removed, the other half heavily damaged, he’s parelized, half blind, his hearing is messed up and he cannot do anything for his self. I care for him 25/8. He will never live a normal independent life as he knew it. The person who shot him -free- not guilty by reason of insanity. But the good news is we don’t live in Danville anymore BUT THAT SICKO DOES! Frightning isn’t it! My son’s memory was replaced with void,confusion,agitation and nightmares. I hope this helps you reconsider your heartfelt concern over this murderer’s quality of life for the next 17 years. Think about it.
It’s getting to the point that shoplifters get more time than murderers….Well, not really, but this is ridiculous!!! Is somebody paying the judge off in some of these cases?
It would have been more time if it had been 1’st degree. Imagine everything you have done for the last 17 years suddenly was erased from your memory and replaced with all bad thoughts. It’s still a lot of life.
58rebel, boy do I disagree with your post! This guy had a previous charge of assault with a deadly weapon on his wife. That shows he had a history of violence and then he commits murder!Come on now! How much do you think someone you loves life is worth? Who knows what anguish went on in the last moments of her life. And as far as 17 years are concerned..that’s still a joke! He won’t even pull 15 years. People have pulled a lot more time for doing a lot less!
17 years is not a joke. In Virginia, if you get a life sentence, you go up for parole in 20. That’s a lot of life to give up. Nothing will help the wife now anyway.
